Understanding Financial Agreements
A Binding Financial Agreement (BFA) is a legally binding contract that outlines how financial matters will be handled in the event of a separation or divorce. We can assist you in drafting, amending, and reviewing BFAs to ensure they are enforceable and meet your specific needs.
Here are some key points to understand about Financial Agreements in Queensland:
- Eligibility: BFAs are available to married couples, de facto couples (including same-sex couples), and couples who are contemplating marriage or a de facto relationship. However, it is crucial to meet specific legal requirements for the agreement to be valid.
- Requirements: To be legally binding, a BFA must be in writing and signed by both parties. Each party must also receive independent legal advice before signing the agreement. The lawyers must certify that they have provided advice on the nature and affect of the agreement.
- Full Disclosure: Both parties must provide full financial disclosure of their assets, liabilities, and financial resources. Failing to do so may invalidate your agreement.
- Enforceability: Once a BFA is correctly drafted and executed, it is legally binding. It can be enforced if one party does not comply with its terms.
- Changing or Revoking: BFAs can be amended or revoked by both parties, provided they both agree in writing and receive independent legal advice on the changes.
